When is insider trading illegal and when is it not? I was of the impression that trading based on material information that was non-public was illegal. Isn't that what Martha Stewart went to jail for? So how can elected members initiate trades based on non-public information in order to out-perform others? I'm not even sure why a special act of Congress was necessary if it was already illegal. Or do our laws not apply to members of Congress?
