He was taken to jail in June following a three-year effort to get an appeals court to overturn his conviction. He has been receiving medical care at an outside hospital since July 30 and appeared before the parole board yesterday, according to a statement from the state Department of Correctional Services.

Medical parole was granted under the state’s Compassionate Release Program, the department said. Marshall will be supervised in New York through June 2016, the date when his maximum sentence expires, Linda Foglia, a spokeswoman for the department, said in an e-mail.

Kenneth Warner, an attorney for Marshall, didn’t immediately return an e-mail seeking comment on the parole board’s decision.

The case is People v. Marshall, 06044-2007, New York Supreme Court, New York County (Manhattan).
